If creditors or debt collectors are calling or texting your cell phone using an automated dialing systems or prerecorded voices without your express consent, they are breaking the law. The Telephone Consumer Protection Act provides that you are entitled to $500 per phone call or text. If the Court finds that the violation is willful it can award $1,500 per call or text. Many creditors and debt collectors depend on these automated dialing systems to place collection calls. Therefore, if a creditor or debt collector is trying to contact you on your cell phone, there’s a good chance they are using an automated dialing system.
